§ 67.1-5-5. Wastewater Discharge Permit Transfer.

Permits may be reassigned to a new owner and/or User only after prior written approval of the Director. The permittee must give at least 30 days advance notice of such reassignment to the Director. Such notice must include a written certification by the new owner and/or User which:

(a)

States that the new owner and/or User has no immediate intent to change the facility's operations and processes.

(b)

Identifies the specific date on which the reassignment is to occur.

(c)

Agrees to assume responsibility for complying with the existing permit.

The failure to obtain the approval of the Director prior to reassignment renders the permit void as of the date of such reassignment. (44-09-67.1.)
