§ 67.1-5-4. Wastewater Discharge Permit Modification.

  • The Director may modify a permit at any time for good cause including, but not limited to, the following:

    (a)

    To incorporate any new or revised Federal, State, or local pretreatment standard or requirement.

    (b)

    To address significant alterations or additions to the Industrial User's operation, processes, or wastewater volume or character since the time of permit issuance.

    (c)

    A change in the POTW that requires either a temporary or permanent reduction or elimination of a previously authorized discharge.

    (d)

    Information indicating that the permitted discharge poses a threat to the POTW, POTW personnel, or the receiving waters.

    (e)

    A violation of any terms or conditions of the permit.

    (f)

    A misrepresentation or failure to fully disclose all relevant facts in the permit application or in any required reporting.

    (g)

    A revision of or a grant of a variance, pursuant to 40 C.F.R. § 403.13, from the Categorical Pretreatment Standards.

    (h)

    To correct typographical or other errors in the permit.

    (i)

    To reflect the transfer of ownership and/or operation of a facility to a new User. (44-09-67.1.)
