§ 82-1-32. Supplemental enforcement of parking.

  • (a)

    Pursuant to the authority provided by Virginia Code § 46.2-1225, as amended, all uncontested parking citations shall be collected and accounted for by the Director of the Department of Tax Administration or the designee of the Director, and the fines paid for such uncontested violations shall be:

    For a violation of Section 82-1-6 (46.2-1242), the fine shall be $500.00;

    For a violation of Section 82-5-7, the fine shall be $100.00;

    For a violation of Section 82-5-26, the fine shall be $50.00;

    For a violation of Section 82-5-14, the fine shall be $50.00;

    For a violation of State Code sections related to the parking of vehicles that have been adopted by reference, pursuant to Virginia Code § 46.2-1313 and Section 82-1-6, the fine shall be $50.00, unless otherwise specified; and

    For all other Sections of Article 5, the fee fine shall be $50.00.

    Within 21 days from the day of the issuance of any notice of parking violation described herein, any owner of the vehicle upon which a violation has been issued shall either (1) tender payment of the fee listed above to the Director of the Department of Tax Administration or the designee of the Director or (2) advise the Director of Tax Administration or the designee of the Director that the person who was issued the violation wishes to contest that violation in the appropriate court of law. Except for instances when the failure to pay or so notify the Director is determined by the Director not to be the fault of the person issued the notice of violation, the Director shall impose a late fee of $25.00 to the owner(s) of any vehicle who neither tenders payment nor notifies the Director that the person wishes to contest the violation within the 21-day period described herein. Furthermore, except as otherwise directed by an appropriate court order, any person who fails to notify the Director or the designee of the Director within 21 days from the date the violation was issued that he or she wishes to contest that violation in court, shall have waived the right to any such contest.

    (b)

    This Section is intended to provide an aid to the strict enforcement of this Chapter without imposing an undue burden upon offenders, and shall be construed as a method of enforcement in addition to and independent of the other methods provided by law and this Chapter. The owner of any vehicle parked in violation of the provisions of this Chapter shall be prima facie responsible for such violation.
