§ 67.1-1-1. Purpose and Policy.

  • This ordinance sets forth uniform requirements for all Users of Publicly Owned Treatment Works ("POTW") of Fairfax County, as well as Fairfax County Users which discharge to POTWs in other jurisdictions and enables the County to comply with applicable State and Federal laws, including the Clean Water Act (33 U.S.C. §§ 1251 et seq.) and the General Pretreatment Regulations (40 C.F.R. §§ 403.1 et seq.). The objectives of this ordinance are:

    (a)

    To prevent the introduction into the POTW of pollutants which will interfere with the operation of the POTW.

    (b)

    To prevent the introduction into the POTW of pollutants which will pass through a POTW, inadequately treated, into receiving waters or the atmosphere or otherwise be incompatible with a POTW;

    (c)

    To protect both POTW personnel who may be affected by wastewater and sludge in the course of their employment and the general public;

    (d)

    To promote reuse and recycling of industrial waste and sludge from the POTW;

    (e)

    To provide for the equitable distribution of the cost of operations, maintenance and improvement of the POTW;

    (f)

    To facilitate compliance with VPDES and NPDES permit conditions, sludge use and disposal requirements and any other Federal or State laws to which POTWs are subject;

    (g)

    To preserve the hydraulic capacity of the POTWs.

    This ordinance authorizes the issuance of wastewater discharge permits, provides for monitoring, compliance, and enforcement activities; establishes administrative review procedures; requires Industrial User reporting; and provides for the setting of fees for the equitable distribution of costs resulting from the program established herein.
