§ 30-2-4. Health of children and staff.

  • All private schools, nursery schools or child care centers shall meet these requirements:

    (a)

    The owner or operator must maintain the following records relating to the health of children and staff:

    (i)

    For each child, a physician's certificate of physical examination performed not more than 90 days before the child's admission.

    (ii)

    For each staff member, a certificate signed by a physician, physician's designee, or Health Department official stating that acceptable screening methods (tuberculin skin test, and/or tuberculosis risk and symptom screen, and/or chest X-ray), singly or in combination as determined appropriate by the signatory, indicate that the staff member is currently free from communicable tuberculosis. The screen must be performed not more than 90 days before the staff member commences employment at the facility and the certificate must be submitted to the owner or operator not later than 21 days after the staff member commences employment. The screen must be repeated, and a new certificate obtained, at least every two years.

    (b)

    Each child shall be immunized against certain communicable diseases as required by Virginia Code § 32.1-46, and the regulations of the State Board of Health.

    (c)

    First aid supplies must be kept on hand at all times.

    (d)

    If the owner or operator has reason to suspect that any child or staff member has contracted any disease in a communicable form or has become a carrier of such disease, the owner or operator shall notify the Director of Health. The Director of Health may require that the owner or operator notify in writing the parent(s) or guardian of all children enrolled of the nature of the communicable disease. Such notice, when required, shall be sent within forty-eight hours. (22-89-30; 4-01-30.)
