§ 118-8-1. Procedures.

(a)

An applicant aggrieved by any decision of the Director of Land Development Services or the Director of the Department of Health in the administration of this Chapter may, within 15 days of such decision, appeal the decision to the Board of Supervisors.

(b)

An applicant or any other party aggrieved by any decision of the Exception Review Committee in the administration of this Chapter may, within 30 days of such decision, appeal the decision to the Board of Supervisors.

(c)

Such appeal shall be filed with the Clerk to the Board of Supervisors and shall state with specificity the provisions of this Chapter which the applicant alleges to have been violated by the decision and the reasons therefore. A copy of the appeal shall also be delivered to the Director of Land Development Services within such 30-day period.

(d)

The time limits set forth in Section 15.2-2259 of Va. Code Ann. shall be tolled during the pendency of an application filed pursuant to Paragraph (a) above. (32-03-118; 29-17-118.)
