§ 1. Little Hunting Creek No Wake Zone

  • Whereas, the Board of Supervisors of Fairfax County, Virginia ("Board"), is authorized to establish "no wake" zones pursuant to Code of Virginia § 29.1-744(D) after notice has been given to the Virginia Department of Game and Inland Fisheries; and

    Whereas, the Board has considered the establishment of a "no wake" zone on Little Hunting Creek which extends along the entire width of that Creek beginning along a line parallel to the George Washington Memorial Parkway (also known as the Mount Vernon Memorial Parkway) and 200 feet to the north of the centerline of the George Washington Memorial Parkway and extending upstream along that Creek to the north until the end of Little Hunting Creek; and

    Whereas, the establishment of the "no wake" zone described above would protect the public safety and prevent erosion damage to property that is adjacent to Little Hunting Creek; and

    Whereas, the Board has given prior notice of the adoption of this ordinance and the establishment of the "no wake" zone described above to the Virginia Department of Game and Inland Fisheries; now therefore, in consideration of the foregoing, be it

    Ordained that a "no wake" zone is hereby established in Fairfax County, Virginia, on Little Hunting Creek that extends along the entire width of that Creek beginning along a line parallel to the George Washington Memorial Parkway (also known as the Mount Vernon Memorial Parkway) and 200 feet to the north of the centerline of the George Washington Memorial Parkway and extending upstream along that Creek to the north until the end of Little Hunting Creek; and

    The "no wake" zone established on Little Hunting Creek by Appendix L shall be subject to the provisions of Section 83-4-12 of the Fairfax County Code, and any violation of Section 83-4-12 shall be punishable in accordance with Section 83-4-14 of the Fairfax County Code. (3-98-L; 18-02-L.)
