E-2. Mason Neck Agricultural and Forestal District (AR 81-V-001 and AA 81-V-001)

  • It is the intent of the Board of Supervisors to renew the Mason Neck Statewide Agricultural and Forestal District as proposed in Application AR 81-V-001-2 pursuant to Code of Virginia, Chapter 36.1 of Title 15.1 and Chapter 114 of the Fairfax County Code on Tax Map Parcels 113-2((1))50, 113-4((1))4-6 and 18; 113-4((5))1, 2, 4-16, and 18-22; 114-3((1))23, 27, and 35; 114-3((2))(3)2 and 3; and 118-1((1))1 and 8-10, and the staff recommends the approval be subject to the following Ordinance Provisions:

    1. The Mason Neck Agricultural and Forestal District shall be reviewed after a period five years from the date of action on this renewal by the Board of Supervisors (January, 1998).

    2. The Conservation Plan (dated March 21, 1995) and the Forest Management Plan (dated September 16, 1997) shall be implemented during the life of the Mason Neck Agricultural and Forestal District. The Conservation Plan and Forest Management Plan shall not be deviated from and shall be amended by the applicant only when it is determined to be necessary by the Soil Conservation Service and/or the Virginia Division of Forestry to incorporate any major changes in the farming operation, such as but not limited to: an increase in the land clearing, changes in crop production and additional water impoundments. The Conservation Plan and Forest Management Plan shall be submitted, including any revisions, with subsequent applications for renewal or amendment of the District for review by the Office of Comprehensive Planning. The applicant shall employ Best Management Practices (BMPs) as promulgated by the Soil Conservation Service and/or the Virginia Department of Forestry.

    3. No parcel included within the District shall be developed to a more intensive use than its existing use at the time of adoption of the ordinance renewing such District for five years from the date of adoption of the renewal of this District (January, 1998). This provision shall not be construed to restrict expansion of, or improvements to, the agricultural or forestal use of the land, or prevent the construction of additional houses within the District, where otherwise permitted by applicable law, for either the owner, a member of the owner's family or for a tenant who farms the land.

    4. No parcel added to an already established District shall be developed to a more intensive use than its existing use at the time of addition to the District for five years from the date of adoption of the original ordinance (January, 1998).

    5. Land used in agricultural and forestal production within the agricultural and forestal district shall qualify for an agricultural and forestal value assessment on such land pursuant to Chapter 4, Article 19 of the Fairfax County Code and Code of Virginia, Section 58-769.4 et seq., if the requirements for such assessment contained there are satisfied.

    6. The Resource Management Division of the Fairfax County Park Authority shall be permitted to survey the property and to recover artifacts from the property. All artifacts will be property of the owners of the land in the District, unless they are transferred to the ownership of the Resource Management Division. Surveys and other similar activities of the Resource Management Division shall be conducted only with the prior permission of the owners of the property and at terms mutually acceptable to both parties established before each occurrence.

    7. Those areas delineated as Environmental Quality Corridors (EQC) shall be left undisturbed, and the boundaries of the EQC shall be the permanent limits of clearing and grading for the life of the Mason Neck Agricultural and Forestal District. There will be no new structures nor clearing and grading permitted in the EQC unless otherwise in conformance with the Forest Management Plan dated September 16, 1997.

    8. The applicant shall submit the Forest Management Plan to the Department of Environmental Management prior to the commencement of work proposed in the Forest Stewardship Plan as required by the Fairfax County Public Facilities Manual. (15-83-A/E; 21-87-E-2; 37-89-E; 1-98-E.)
